Article 1 – General Provisions

1. Effectiveness of the General Conditions
These general conditions of sale described herein govern the purchase of Products and services, made remotely and made available via the Internet, from the website www.esteteam.com (hereinafter, the "Site") in compliance with current Italian legislation pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code"), where applicable, and in compliance with national and international regulations regarding e-commerce.
The seller of the products and owner of the site is ESTETEAM SRL, represented by its legal representative pro tempore, with registered office in Milan, Via Varesina 174, VAT no. 12632430158, registered in 20156 Milan, registered in the Economic and Administrative Index of the Milan Chamber of Commerce under no. 1573635, (hereinafter, the "Seller").
Users accessing the Site to make purchases (hereinafter the "Customer") are required to carefully read this document, made available on the Site and accepted during account registration.

2. Selecting and Ordering Products
The characteristics and prices of the various Products for sale on the Site (hereinafter the "Product" or "Products") are shown on the page for each Product.
To purchase retail Products, the Customer must complete and submit the order form electronically, following the instructions on the Site.
When adding the Product to the cart, the Customer must enter the shipping information and any billing information (if purchasing with a VAT number, a certified email address or, alternatively, the SDI code must be provided). The Customer must then select the desired payment method and confirm the order.
By submitting an order on the Site, which constitutes a contractual proposal, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept this document and the Privacy Policy.
The contract between ESTETEAM SRL and the Customer is deemed concluded upon acceptance of the order by the Seller.
This acceptance is communicated to the Customer via an order confirmation email containing the order number, shipping and billing information, a list of the Products ordered with their essential characteristics, and the total price, including any shipping costs.
Upon receiving the confirmation email, the Customer may modify the order until the sent update message is displayed in their Customer Area.
After this update, changes will no longer be accepted, and the Customer, if identified as a consumer, must exercise the right of withdrawal, as required by current legislation.
After receiving the order and verifying the accuracy and completeness of the information, ESTETEAM SRL will process the order.
If one or more Products are unavailable, customer service will promptly notify the Customer using the contact information provided during registration.
Within 72 business hours of receiving notification that the Product is unavailable, the Customer will have the option to wait for the Product to become available, according to the timeframe indicated by the Seller, or cancel the order.
In the event of order cancellation for unavailable Products, the Customer will be refunded the amount already paid within 72 business hours using the payment method chosen at the time of purchase.
Cancellation of the order will result in invoicing only for the Products shipped.

3. Product Information
Information and specifications for each individual Product are available on the relevant page on the Website.
Visual representations of the Products, where available, are for illustrative purposes only.
Any modification to the Product packaging will not alter the quality and characteristics of the Product, as detailed in the relevant product description.

4. Promotions – Discounts – Freebies
ESTETEAM SRL may include discount coupons in packages, send them via email, or send them through partner sites. These coupons can be used by the expiration date indicated on the coupon.
The discount coupon must be entered in the "Discount Code" box on the cart page.
Once the code is applied, the system will update the total order amount, net of the coupon value.
Use of the coupon is governed by the following terms and conditions:
Coupons cannot be combined with other commercial offers;
Coupons have a predefined value or can be in the form of a percentage discount;
They have an expiration date indicated on the coupon itself;
The coupon does not entitle customers to change, will not be refunded, in whole or in part, and must be used by the expiration date. The coupon does not can be resold;
For fixed-value coupon codes, if the nominal value indicated is not sufficient to cover the order amount, the buyer may complete the order by paying the difference.

5. Prices and Shipping
Product prices are expressed in euros and are indicated on the relevant page.
Before proceeding with the purchase, the cart section displays the total cost of the goods and the shipping fee.
The Products sold are not subject to any import taxes or customs duties if the Product is sold and delivered in Italy or within the European Union.
For deliveries to countries outside the European Union, the Products may be subject to import taxes and/or customs duties.
It is impossible to predict whether and what costs will be incurred for customs clearance of the goods.
For further information, please contact your country's customs office.
In all cases, any costs related to import taxes and/or customs duties will be borne by the Customer.

6. Payment Methods and Invoicing

6.1 Payment Methods
The Customer may pay for the Products and related shipping and delivery costs by credit card, debit card, online payment system (PayPal, Scalapay), advance bank transfer, or cash on delivery:

Credit/Debit Card
Payment for Products purchased on the Site can be made by credit/debit card directly through the Site.
ESTETEAM SRL accepts VISA, Mastercard, and Maestro credit/debit cards. Accepted credit/debit cards are listed on the Site page. The total amount due by the Customer is charged upon order placement.
To ensure the security of payments made on the Site and prevent fraud, ESTETEAM SRL reserves the right to request that the Customer send a copy of the front and back of their valid ID card by replying to the email received.
The Customer is required to send the requested documents within the timeframe specified in the email.
If ESTETEAM SRL does not receive these documents within the timeframe specified in the request email, or if it receives expired or invalid documents, the contract will be automatically terminated pursuant to Article 1456 of the Italian Civil Code, and the order will consequently be cancelled. ESTETEAM SRL reserves the right to seek compensation for any damages it may incur as a result of the Customer's non-compliant behavior.
Termination of the contract, of which the Customer will be notified via email, will result in cancellation of the order and a refund of the total amount due, if paid, via credit to the same payment method used.
If ESTETEAM SRL promptly receives the required valid documentation, the delivery terms applicable to the order will start from the date of receipt of such documentation.
ESTETEAM SRL uses a secure payment service that uses the SSL security protocol.
Confidential credit card information (for example, cardholder name, card number, expiration date, security code) is encrypted and transmitted to the payment processor.
ESTETEAM SRL therefore never has access to or stores the credit/debit card information used by the Customer to pay for the Products, even when the Customer saves payment methods, except for the cardholder's information.

PayPal
PayPal is a fast and secure payment system used and widely used by most e-commerce sites.
Once this payment method is selected, the system communicates directly with PayPal in complete security, so ESTETEAM SRL, as in the case described above, never gains access to the payment method information.
The amount will be charged directly to the payment method associated with your PayPal account. The order amount will be charged to your PayPal account upon order placement.
In the event of cancellation, the amount will be refunded to your PayPal account.

Payment by Advance Bank Transfer
If you choose to pay by bank transfer, you must make the transfer at the time of ordering.
The bank details for payment will be included in the order confirmation email.
If you do not receive the email after completing your order, please check your spam/junk folder or contact customer service to verify the correct email address.
Products will be shipped only after payment has been received, and under no circumstances will ESTETEAM SRL accept the CRO and/or payment slips will be sent as a guarantee for the bank transfer to expedite order processing.

6.2 Order Invoicing
If the purchase is made by a professional/business, it will be possible to request an invoice during the order process by entering the billing information, including tax code and/or VAT number, certified email address, or SDI code.
In this case, the invoice, in electronic format, will be sent to the Exchange System, and a courtesy copy will be sent by email to the address provided during the purchase or registration process.
The professional/business is responsible for correctly entering the billing information and is expressly informed that, if an invoice is not requested during the order process, it will not be possible to request one later.

7. Shipping and Delivery
Products purchased on the Site will be delivered to the address indicated by the Customer in the appropriate field during the purchase process.
All purchases will be delivered by express courier (hereinafter, the "Courier").
ESTETEAM SRL is not responsible for unforeseeable delays or delays beyond its control.
Once the Products have been shipped, the Customer will receive a confirmation email.
If the confirmation email is not received, the Customer should check their spam/junk folder or contact customer service to verify the correct email address.
The Customer can track the status of their shipment using the tracking services provided by the courier.
The shipping service includes an initial delivery attempt to the address indicated at the time of ordering.
A notification will be left after each delivery attempt.
A new delivery attempt will be scheduled.
If the package is not collected on the second delivery attempt, it will be held at the courier's local office and subsequently returned to the sender.
If the package is returned to the sender, the Customer may request a new shipment, paying only the costs of the new shipment, which will be communicated by ESTETEAM SRL via email.

8. Right of Withdrawal
This section applies only to Customers identified as "Consumers" pursuant to Article 3 of Legislative Decree 206/2005 (Consumer Code).
The consumer, as required by law, has the right to withdraw from the contract within 14 days without stating any reason.
The withdrawal period therefore expires 14 days after the consumer, or a third party other than the carrier and designated by the consumer, acquires physical possession of the goods.
To exercise the right of withdrawal, you must promptly inform ESTETEAM SRL (include your name, address, and, if available, telephone and fax numbers and email address) of your decision to withdraw from this contract by means of an explicit statement (e.g., a letter sent by post, fax, or email).
If you withdraw from this contract, the amount paid for the purchase will be refunded, minus shipping costs, without undue delay and in any case no later than 14 days from the day on which ESTETEAM SRL was informed of your decision to withdraw from this contract.
Such refunds will be made using the same payment method used for the initial transaction unless expressly agreed otherwise; in any case, you will not incur any costs as a result of such refund, except, as explained above, any shipping costs already incurred. The refund may be suspended until the goods are received.
The direct costs of returning the goods will be borne by the consumer.
The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. The customer will be responsible for packaging the goods when returning them. If the Product is damaged, the return cannot be completed.

Please note that the right of withdrawal does not apply to sealed goods that are not suitable for return due to hygiene or health protection reasons and have been opened after delivery.
If you purchase with a VAT number, you cannot exercise the right of withdrawal.

Return Instructions
To make a return, you must contact the Seller via the contact section on the Website, indicating the order number and date of purchase.
To exercise the right of withdrawal, the Products must be returned in the same condition as when delivered, complete with all their parts, components, and accessories, labels, and packaging, using, where possible, 

The original packaging must be used, or, where this is not possible, suitable packaging must be used to protect the goods from damage or alteration.
ESTETEAM SRL reserves the right to inspect the Products upon receipt and refuse the refund request if the Products do not comply with the aforementioned requirements.
In the event of damage during transport during the return process, ESTETEAM SRL will notify the Customer within five (5) business days of receiving the goods, allowing the Customer to file a complaint with the courier used for transport.
The damaged goods will be made available for return to the Customer, and the return request will be cancelled at the same time.

9. Warranty and Lack of Conformity
In the event of lack of conformity of Products sold by ESTETEAM SRL, the Customer must immediately contact customer service at the contact details indicated on the Website.
All Products sold by ESTETEAM SRL are covered by the manufacturer's standard warranty and the 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02.
To benefit from warranty service, the Customer must retain the receipt (or invoice) received in the package, attached to the purchased Product. The manufacturer's standard warranty is provided according to the procedures described in the documentation included in the Product packaging.

10. Errors and Limitations of Liability
The information relating to the Products provided through the Site is constantly updated.
ESTETEAM SRL reserves the right to correct errors, inaccuracies, or omissions, even after an order has been placed, or to modify or update the information at any time without prior notice, without prejudice to the Customer's rights under this document.
Except in the case of willful misconduct or gross negligence, the Customer is excluded from any right to compensation for damages or the award of compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the failure to accept or fulfill, even partially, an order.
All content on the Site is intended for informational purposes only and is intended solely to inform customers or potential customers during the pre-purchase phase of the Products sold by ESTETEAM SRL.

11. Complaints
Any complaints must be forwarded to ESTETEAM SRL using the contact details provided on the Site.
ESTETEAM SRL undertakes to respond to all requests received within a maximum of 10 business days.

12. Online Consumer Dispute Resolution (ODR)
If you are a European citizen, you should be aware that the European Commission has made a dedicated alternative dispute resolution tool available to all European residents.

13. Joint Conciliation
Pursuant to Article 49, paragraph 1, letter V of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), the Customer may avail of the Joint Conciliation procedure. This procedure may be initiated if the consumer, after submitting a complaint to the company within thirty days, has not received a response or has received a response that is not satisfactory. Customers who choose to use the Joint Conciliation procedure are required to submit their complaint to conciliazione@consorzionetcomm.it or fax 02/87181126.

14. Applicable law and jurisdiction
The sales contract between the Customer and ESTETEAM SRL is deemed to have been concluded in Italy and is governed by Italian law.
For disputes relating to the interpretation, execution, or termination of this contract or individual purchase orders, if the Customer is a consumer pursuant to the Consumer Code, the court of the Customer's municipality of residence or domicile, if located in Italy, shall have exclusive jurisdiction. In all other cases, the Court of Milan shall have exclusive jurisdiction, excluding any other competent court.

Pursuant to Article 1341 of the Italian Civil Code, the Customer declares to have read and specifically accepts the following articles of these General Conditions: 7, 10, and 14.
